Terms of Service

Introduction

These Terms of Service (“Terms”) govern your access to and use of ScoreIt, including our website at scoreitathletics.com, our web application at app.scoreitathletics.com, and any school athletics websites we host on your behalf (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ScoreIt provides tools for high school athletics programs to create social media graphics, manage schedules, and publish athletics websites. Features include graphic templates, optional AI-assisted graphic creation (Pro plan), downloadable PNG exports, and customizable public athletics websites. We may add, modify, or discontinue features at any time.

2. Eligibility and Accounts

• You must be at least 13 years old to create an account. The Service is intended for use by school staff and authorized athletics administrators.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information when creating your account and to keep it up to date.
• You may not share your account with unauthorized users or use the Service on behalf of a school without appropriate authorization from that school.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with:

• These Terms and our Privacy Policy.
• All applicable laws and regulations.
• Your school's policies and guidelines.

You agree not to:

• Upload or publish content that is unlawful, defamatory, harassing, or infringes third-party rights.
• Use the Service to distribute malware, spam, or misleading information.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Reverse engineer, scrape, or abuse the Service in ways that exceed reasonable use.
• Circumvent usage limits, subscription requirements, or security measures.

4. User Content

You retain ownership of content you submit through the Service, including graphics, images, schedules, and website content (“User Content”). By submitting User Content, you grant ScoreIt a non-exclusive, worldwide license to host, store, display, reproduce, and process it solely to operate and provide the Service — including publishing your athletics website and processing images through third-party tools you choose to use (such as background removal or AI generation).

You are solely responsible for User Content you submit. You represent and warrant that you have all rights necessary to submit User Content and that it does not violate any law or third-party rights. ScoreIt reserves the right, but is not obligated, to remove or disable access to User Content that violates these Terms or is otherwise objectionable.

5. Subscriptions and Billing

ScoreIt offers a free plan and a paid Pro subscription. Current plan features and pricing are described on our website. Pro subscriptions are billed monthly through Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.

• Free plan. Includes core features subject to usage limits (such as monthly graphic download caps) as described on our pricing page.
• Pro plan. Includes additional features such as unlimited graphic downloads, AI graphic generation (subject to monthly limits), custom domain support, and white-label website options.
• Cancellation. You may cancel your Pro subscription at any time through the billing portal in Settings. Cancellation takes effect at the end of your current billing period unless otherwise stated.
• Refunds. Payments are generally non-refundable except where required by law or at our discretion.

We may change pricing or plan features with reasonable notice. Price changes apply to subsequent billing periods.

6. Athletics Websites

If you enable a public athletics website, you are responsible for the content published on it. Public site content may be indexed by search engines and viewed by anyone on the Internet. You are responsible for ensuring published contact information, schedules, and other details are accurate and appropriate for public display.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

ScoreIt and its licensors own all rights in the Service, including software, templates, designs, trademarks, and logos (excluding your User Content). We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.

9. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), Google Firebase (infrastructure), and Ideogram (AI generation and background removal). Your use of those features may be subject to the third party's terms and policies. ScoreIt is not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCOREIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OR THIRD-PARTY-PROCESSED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOREIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SCOREIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Modification of Terms

We may modify these Terms at any time by posting updated Terms on this page. Material changes will be indicated by updating the “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
